2. TERMS OF SERVICE
2.1. Acceptance of Terms

These Terms of Service govern your access to and use of Monetiva and monetiva.am.
By creating an account, accessing the platform or otherwise using Monetiva, you agree to these Terms.
If you do not agree, you must not use Monetiva.
2.2. About Monetiva

Monetiva provides technology and services related to affiliate marketing.
The platform may allow approved users to:
  • discover affiliate campaigns;
  • obtain referral links;
  • promote participating brands, products or services;
  • track clicks and conversions;
  • view commission information;
  • receive approved commissions.
Unless expressly stated otherwise, Monetiva is not the seller, manufacturer or provider of products and services promoted through affiliate campaigns.
Purchases are made directly from the relevant advertiser, merchant or third party.
2.3. Eligibility

To create and use an affiliate account you must:
  • have legal capacity to enter into a binding agreement;
  • be at least 18 years old unless Monetiva expressly permits otherwise;
  • provide accurate registration information;
  • comply with applicable laws;
  • comply with these Terms and any campaign-specific conditions.
  • Monetiva may reject an application at its discretion where reasonably necessary to protect the platform, advertisers or other users.
2.4. Accounts

You are responsible for:
  • maintaining accurate account information;
  • protecting your login credentials;
  • all activity performed through your account;
  • informing Monetiva promptly about suspected unauthorized access.
You may not sell, transfer or share your account without Monetiva's written authorization.
Creating multiple accounts to manipulate tracking, promotions, eligibility or commission rules is prohibited.
2.5. Campaign Conditions

Each campaign may have additional requirements concerning:
  • eligible countries;
  • traffic sources;
  • promotional channels;
  • commission rates;
  • eligible products;
  • attribution periods;
  • conversion requirements;
  • advertising restrictions;
  • coupon codes;
  • brand guidelines.
Campaign-specific rules form part of these Terms.
If campaign-specific rules conflict with general promotional permissions, the stricter campaign rule applies.
2.6. Referral Tracking

Monetiva uses tracking systems to determine whether a transaction is attributable to an affiliate.
Tracking may depend on third-party technologies and systems.
Monetiva cannot guarantee that every click, visit or purchase will be successfully tracked.
Transactions that cannot be validly attributed may not qualify for commission.
2.7. Commissions

Displayed commissions may initially be classified as pending.
A pending commission does not constitute a final payment obligation.
A commission becomes payable only after the relevant transaction has been validated under the applicable campaign conditions.
Commissions may be rejected, cancelled or reversed where, for example:
  • an order is cancelled;
  • a product is returned;
  • a customer receives a refund;
  • payment fails;
  • the transaction is fraudulent;
  • the transaction violates campaign conditions;
  • prohibited traffic was used;
  • tracking was manipulated;
  • the transaction is a prohibited self-referral;
  • the advertiser or network determines that the transaction is invalid.
Commission rates may vary between campaigns.
2.8. Payments

Approved commissions will be paid according to the payout schedule, minimum payout threshold, currency and payment methods communicated through Monetiva or the applicable campaign terms.
Users are responsible for providing accurate payment information.
Monetiva is not responsible for delays caused by incorrect payment details, financial institutions, payment processors, compliance reviews or circumstances outside Monetiva's reasonable control.
2.9. Taxes

Affiliates are responsible for determining and fulfilling their own tax, registration, reporting and other legal obligations arising from commissions received through Monetiva, unless applicable law expressly requires Monetiva to perform such obligations.
Monetiva may request tax-related information or documentation where reasonably necessary.
2.10. Prohibited Uses

Users must not:
  • generate fake clicks, leads or purchases;
  • use bots or automated traffic;
  • manipulate cookies or attribution;
  • use cookie stuffing;
  • make unauthorized self-referrals;
  • create fraudulent accounts;
  • provide misleading information;
  • impersonate Monetiva or an advertiser;
  • make false claims about products or services;
  • send unlawful spam;
  • violate intellectual-property rights;
  • use malware, spyware or deceptive redirects;
  • interfere with platform security;
  • attempt to access another user's account;
  • use prohibited advertising channels;
  • violate advertising-platform policies;
  • engage in unlawful, fraudulent or deceptive activity.
2.11. Suspension and Termination

Monetiva may suspend or terminate access where we reasonably believe that:
  • these Terms have been violated;
  • fraud or abuse has occurred;
  • a user creates legal or reputational risk;
  • an advertiser or network requires suspension;
  • information provided by the user is false;
  • security risks exist;
  • continued access may harm Monetiva or third parties.
Where permitted, unpaid commissions connected to fraudulent or prohibited activity may be cancelled.
2.12. Intellectual Property

Monetiva's website, software, trademarks, designs, text, graphics and other materials are owned by or licensed to Monetiva.
Users receive only the limited rights necessary to use the platform.
Advertiser trademarks and promotional materials remain the property of their respective owners.
2.13. Third-Party Products and Services

Monetiva does not control products, pricing, stock, delivery, warranties, customer service, refunds or other terms offered by third-party merchants unless explicitly stated otherwise.
Any purchase contract is normally between the customer and the relevant merchant.
2.14. Disclaimer

Monetiva does not guarantee:
  • any minimum earnings;
  • continuous availability of campaigns;
  • uninterrupted platform access;
  • that every referral will result in a commission;
  • that every transaction will be successfully tracked.
Affiliate earnings depend on actual qualifying activity.
2.15. Limitation of Liability

To the maximum extent permitted by applicable law, Monetiva will not be liable for indirect, incidental, special or consequential losses arising from use of the platform, third-party products, unsuccessful tracking or decisions made by advertisers or affiliate networks.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
2.16. Changes to the Service

We may add, remove or modify platform features, campaigns, commission structures or technical functionality.
Campaigns may be paused or discontinued without guaranteeing continued availability.
2.17. Changes to These Terms

We may update these Terms from time to time.
Continued use after an updated version becomes effective constitutes acceptance of the revised Terms where permitted by law.
2.18. Governing Law

These Terms are governed by the laws of the Republic of Armenia, unless mandatory applicable law requires otherwise.
2.19. Disputes

Users should first contact Monetiva at info@monetiva.am to attempt to resolve a dispute.
If a dispute cannot be resolved amicably, it may be submitted to the competent courts of the Republic of Armenia, unless mandatory applicable law provides otherwise.
3. AFFILIATE / CREATOR TERMS
These Affiliate / Creator Terms apply to persons who participate in Monetiva campaigns as creators, publishers, influencers, affiliates or promotional partners.
They supplement the Monetiva Terms of Service.
3.1. Creator Approval

Registration does not automatically guarantee approval.
Monetiva may review:
  • promotional channels;
  • audience;
  • content quality;
  • geographic relevance;
  • promotional methods;
  • compliance history.
Some campaigns may require additional approval.
3.2. Permitted Promotion

Subject to campaign-specific restrictions, creators may promote referral links through approved channels including:
  • social media posts;
  • Instagram Stories;
  • TikTok;
  • Telegram;
  • websites;
  • blogs;
  • video content;
  • other channels approved by Monetiva.
The fact that a channel is generally permitted does not mean it is permitted for every campaign.
3.3. Affiliate Disclosure

Creators must clearly disclose their commercial relationship when required by applicable advertising, consumer-protection or platform rules.
Disclosures should be clear and understandable to the audience.
Examples may include:
  • “Affiliate link”;
  • “I may earn a commission from this purchase”;
  • “Ad” or equivalent disclosure where appropriate.
Creators must not intentionally hide the commercial nature of promotional content.
3.4. Referral Links

Referral links must be used substantially in the form provided by Monetiva.
Creators must not manipulate tracking parameters or use technical methods designed to claim commissions for users they did not legitimately refer.
URL-shortening tools may be used only where permitted by the applicable campaign and where they do not interfere with tracking or disclosure requirements․
3.5. Commission Attribution

A commission is generated only when Monetiva or the relevant advertiser/network successfully attributes a qualifying action to the creator.
Attribution may depend on:
  • cookie duration;
  • attribution window;
  • campaign rules;
  • browser settings;
  • customer behavior;
  • use of multiple devices;
  • other affiliate links clicked by the customer;
  • technical tracking limitations.
Monetiva does not guarantee attribution for every referral.
3.6. Pending Commissions

Transactions may remain pending while the advertiser or network verifies:
  • successful payment;
  • order completion;
  • return periods;
  • cancellation periods;
  • fraud indicators;
  • campaign eligibility.
Pending commissions are estimated earnings and are not final until approved.
3.7. Rejected or Reversed Commissions

A commission may be rejected or reversed where:
  • an order is cancelled;
  • merchandise is returned;
  • a refund or chargeback occurs;
  • payment is unsuccessful;
  • the order is fraudulent;
  • a duplicate transaction exists;
  • campaign requirements are not met;
  • tracking is manipulated;
  • prohibited promotional methods are used;
  • the transaction is a prohibited self-referral;
  • the advertiser or affiliate network invalidates the transaction.
3.8. Self-Referrals

Creators may not use their own referral links for personal purchases unless a campaign expressly allows self-referrals.
Purchases made for the purpose of artificially generating commissions may be rejected and may result in account suspension.
3.9. Paid Advertising

Creators may use paid advertising only where the relevant campaign expressly permits it.
Without explicit authorization, creators must not:
  • bid on an advertiser's protected brand terms;
  • impersonate an advertiser;
  • use misleading domains;
  • send paid traffic directly to an affiliate link where prohibited;
  • create advertisements implying that they are officially operated by the advertiser;
  • violate Google, Meta, TikTok or other advertising-platform policies.
3.10. Coupon Codes

Creators may only promote coupon codes:
  • supplied through Monetiva;
  • publicly authorized by the advertiser;
  • otherwise expressly approved.
  • Creators must not publish unauthorized, fabricated, expired or misleading coupon codes.
3.11. Content Requirements

Creators must ensure that promotional content:
  • is accurate;
  • is not intentionally misleading;
  • does not contain false pricing or discount information;
  • does not make unsupported claims;
  • respects intellectual-property rights;
  • follows advertiser brand guidelines;
  • complies with applicable platform rules and laws.
3.12. Prohibited Traffic

Prohibited traffic includes, without limitation:
  • bots;
  • click farms;
  • automated clicks;
  • fake accounts;
  • incentive abuse;
  • cookie stuffing;
  • forced redirects;
  • malware;
  • misleading pop-ups;
  • spam;
  • unauthorized email marketing;
  • fabricated transactions;
  • stolen payment methods;
  • deceptive traffic sources.
  • Monetiva may withhold commissions connected to prohibited traffic.
3.13. Brand Assets

Creators may use advertiser logos, product images, banners and other materials only for authorized campaign promotion.
Such materials may not be materially altered in a misleading or damaging manner.
No ownership of advertiser intellectual property is transferred to the creator.
3.14. Earnings

Monetiva does not guarantee any specific level of earnings.
Results depend on factors including audience, traffic, conversion rates, commission rates and advertiser validation.
3.15. Payment

Payments are made only for approved commissions and according to the payout conditions shown by Monetiva.
Creators must provide accurate payment information and any documentation reasonably required for payment or compliance purposes.
3.16. Taxes and Legal Status

Creators are responsible for determining whether their affiliate activity creates tax, business registration, reporting, licensing or other obligations in their jurisdiction.
3.17. Monitoring and Compliance

Monetiva may review promotional activity to verify compliance.
Creators may be asked to provide information about traffic sources or promotional methods.
Failure to provide reasonably requested information may result in campaign restrictions or suspension.
3.18. Termination

Creators may stop participating at any time.
Monetiva may suspend or terminate participation for violations, fraud, advertiser requirements, legal concerns or material risk to the platform.
4. AFFILIATE DISCLOSURE
Monetiva participates in affiliate marketing arrangements with advertisers, merchants and affiliate networks.
Some links available through Monetiva are affiliate or referral links.
When a user clicks an affiliate link and completes a qualifying purchase or other action, Monetiva and/or the creator who shared the link may receive a commission or other compensation.
This generally does not increase the price paid by the customer unless explicitly stated otherwise.
Commission relationships may influence which merchants, products, services or offers appear on Monetiva.
However, compensation does not change the customer's contractual relationship with the merchant.
Products and services promoted through affiliate links are normally sold and fulfilled by independent third-party merchants.
Creators using Monetiva are responsible for making any affiliate disclosures required by applicable laws and advertising-platform rules.
